The black-white-red imperial flags are used as a distinguishing mark for right-wing extremists. Officials in Bremen may in future confiscate the flags and impose high fines.
The federal state of Bremen has banned the Imperial and Imperial battle flags in public. A similar announcement will come into force next Monday, as the city's interior authorities announced. According to the information, the police law will be supplemented by a provision that prohibits the public display and use of the historical flags. Officials are allowed to confiscate the flags if they are violated, and the owners will be subjected to a fine of up to 1,000 euros. Bremen's Interior Senator Ulrich Mäurer (Social Democratic Party Germany) described the flags as "symbols of National Socialist and xenophobic sentiments" that should be banned from the public. "It was time to act," he said, referring to the recent events in demonstrations against the measures to contain the corona pandemic in Berlin, where right-wing extremists waved the flags of the German Empire in front of the Reichstag. The Imperial flags have long been regarded as a symbol of identification for right-wing extremists, citizens of the Reich and other anti-democratic forces. Unlike swastika flags and similar National Socialist badges, they are not prohibited. So far there have only been provisions that the police can confiscate them in certain cases, for example during demonstrations. According to the Bremen Interior Authority, the decree justifies the ban by stating that showing the black, white and red flags "represents a lasting impairment of the requirements for an orderly civic coexistence and thus a danger to public order". It applies to all variants of the Imperial War Flag. The simple imperial flag is only affected if "there is a specific provocation effect in the individual case".
Analysis:
The ban comes after the increasing amount of protests against the Covid restrictions imposed by the Federal German government. In these protests, the symbol is commonly used to express the disillusion of the German people with the government. The symbol has been used by authoritative extremists in the past, however rather has only been used politically by the German National People's Party. A political party carrying around 10 percent of the vote in the Weimar Republic and stood for the reformation of the German Empire. The leaders of the party were executed in 1944 by the Nazis following their part in an assassination attempt on Adolf Hitler. Following the war, they were unable to reform with no leadership in place. This ban is alleged to be in direct violation of the German Constitution, and will be challenged but a decision will be pending for quite a time.

Die Reichs- und Reichskriegsflaggen gelten seit Langem als ein Erkennungszeichen von Rechtsextremen, Reichsbürgern und anderen Demokratiegegnerinnen. Anders als Hakenkreuzfahnen sowie ähnliche nationalsozialistische Abzeichen sind sie nicht verboten. Es gab bisher lediglich Bestimmungen, wonach die Polizei sie etwa bei Demonstrationen in bestimmten Fällen beschlagnahmen kann.
In dem Erlass wird das Verbot laut Bremer Innenbehörde damit begründet, dass das Zeigen der schwarz-weiß-roten Flaggen "eine nachhaltige Beeinträchtigung der Voraussetzungen für ein geordnetes staatsbürgerliches Zusammenleben und damit eine Gefahr für die öffentliche Ordnung" darstellt. Es gilt für alle Varianten der Reichskriegsflagge. Die einfache Reichsflagge ist nur betroffen, wenn "eine konkrete Provokationswirkung im Einzelfall besteht".
